In 2022, the <\/span><b>U.S. Federal Trade Commission (FTC)<\/b><span style=\"font-weight: 400;\"> announced it would take action against companies using deceptive UX to trick users into subscriptions or misuse personal data.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In India, the government has taken decisive steps to rein in such practices. In November 2023, <\/span><a href=\"https:\/\/www.moneycontrol.com\/news\/business\/startup\/how-dark-patterns-quietly-trick-you-and-why-the-government-s-calling-them-out-13058071.html\"><span style=\"font-weight: 400;\">the Department of Consumer Affairs officially classified 13 types of dark patterns as \u201cunfair trade practices\u201d under consumer protection law.<\/span><\/a><span style=\"font-weight: 400;\"> These include false urgency, subscription traps, disguised ads, and interface interference &#8211; among others.<\/span><\/p>\n<p><a href=\"https:\/\/www.moneycontrol.com\/news\/business\/startup\/how-dark-patterns-quietly-trick-you-and-why-the-government-s-calling-them-out-13058071.html\"><span style=\"font-weight: 400;\">Most recently, on May 28, 2025, the Consumer Affairs Ministry held a high-level meeting with senior representatives of major e-commerce platforms. <\/span><\/a><span style=\"font-weight: 400;\">They were directed to comply with the dark pattern regulations, conduct internal audits, and publicly display audit results. Consumer Affairs Minister Pralhad Joshi also proposed the formation of a joint working group to address and monitor dark pattern usage more comprehensively.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Even beyond regulation, user expectations are shifting. As people grow more digitally literate, they&#8217;re quick to spot and reject manipulation. <\/span><a href=\"https:\/\/www.shopify.com\/enterprise\/blog\/44272899-how-to-reduce-shopping-cart-abandonment-by-optimizing-the-checkout\"><span style=\"font-weight: 400;\">According to Shopify, over a quarter of users abandon checkouts due to forced account creation, a subtle but impactful dark pattern.<\/span><\/a><\/p>\n<h2><strong>Drawing the Line: Questions Every Designer Should Ask<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">If you\u2019re a UX designer, product manager, or founder, here are a few questions to help you evaluate whether your design leans toward ethical persuasion or veers into dark territory:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Is the user fully informed?<\/b><b><br \/>\n<\/b><span style=\"font-weight: 400;\">Are all terms, conditions, and consequences clearly communicated?<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Is it easy to opt out?<\/b><b><br \/>\n<\/b><span style=\"font-weight: 400;\">Can users reverse or reject the action without friction?<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Is the design respectful of user intent?<\/b><b><br \/>\n<\/b><span style=\"font-weight: 400;\">Are buttons, checkboxes, and flows designed to match what the user logically expects?<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Is this nudging or shoving?<\/b><b><br \/>\n<\/b><span style=\"font-weight: 400;\">Does the design guide or does it corner?<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Would we feel comfortable showing this design to users face-to-face?<\/b><b><br \/>\n<\/b><span style=\"font-weight: 400;\">If not, it might be a dark pattern.<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">To see how this plays out in practice, consider the example of cookie consent banners:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Banner A:<\/b><span style=\"font-weight: 400;\"> \u201cWe value your privacy. Customize your settings or accept all cookies.\u201d Both choices are clearly labeled, visible, and equally easy to access.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Banner B:<\/b><span style=\"font-weight: 400;\"> \u201cAccept All\u201d is a large, brightly colored button. The opt-out or customization option is hidden behind several clicks or placed in a hard-to-read link.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Both banners are technically legal. Both aim to secure user consent.
